Terms & Conditions
Margarita’s Bakery makes every effort possible to create an original cake designed to your exact wishes. But it is your responsibility to ensure that your wishes and color swatches are clearly stated; and that photographs and other design aspects are given accurately to your cake designer. All design aspects that you have agreed to supply must be delivered to our location no later than 7 working days prior to cake delivery date to ensure that we have all necessary pieces to decorate your cake (i.e. beads, ornaments, ribbon, faux flowers, jewelry, etc). Cake toppers can be left on the cake table and placed on your cake at the time of delivery or delivered to the store. The date of your final payment is the final date for any changes.
A minimum deposit of 50% non-refundable is required to schedule a cake. And the final payment should be done 7 days before the scheduled delivery/pickup.
We cannot accept your order if you’re using different vendors for the same final product, such as a small party cake from us and sheet cakes from a warehouse club store or grocery store. We do this in order to protect our reputation and your guests, in the end, will thank you.
The final date for full payment and any changes to be done to the cake is 7 working days before the event. If payment in full is not received 7 working days in advance of your event, your cake(s) will be considered canceled and any payments made will NOT be refunded. Your cake will not be baked, decorated, delivered or set up. If we do agree in advance to accept a late payment, it must be written and signed.
We require a rental deposit to ensure proper handling. All rented equipment must be returned to Margarita’s Bakery within five (5) days following the cake delivery date. If additional time is needed to return items, arrangements must be made at the time of final payment. Late or damaged pieces will forfeit your rental deposit.
Once all stands, cake boards, and other devices have been returned in the same condition as received, your deposit will be promptly refunded according to your specific contract. Damaged items will forfeit all rental deposits. Please wipe down all noticeable food or foreign material from the rented equipment. Do Not Wash.
Changes to your cake order, size, description, flavor, etc. will be accepted up to 7 days prior to delivery or as soon as possible. These changes may be subject to additional charges. Any changes requested after the lockout date will not be accepted.
Even with advance notice, we may not be able to accommodate changes in location, date or delivery times due to a prior scheduling of other contracts. If your changes preclude you from using Margarita’s Bakery, please refer to the Cancellation section of this contract.
DELIVERY / SET-UP
We are not responsible for any damage to your cake(s) after our delivery and setup's complete. The client is responsible for providing an appropriate size, level, and stable table with a cool and safe environment for the cake(s). If the table is to be skirted or otherwise covered, it must be prepared before the cake is delivered. We are not responsible for damage resulting from tables that are not level, weak, too small, or placed in a warm area. Make sure that you have an umbrella o canopy for shade. Please keep in mind that there can be wind, rain, temperature, pets, bugs, or other situations, especially for outdoor deliveries that can harm or cause damage to your cake.
Please have a trusted individual present at the time of delivery to accept the delivery. In the case of a mishap or damage, Margarita’s Bakery will advise them immediately. Once the cake is set up and accepted, it is no longer the responsibility of Margarita’s Bakery and we will not be held responsible.
We are not responsible for damage to your cake if someone at your reception site moves your cake after it has been safely delivered and set-up. We photograph all our cakes upon completion of delivery.
If you have chosen to have your order picked up, we cannot be responsible for damage to any cake once it has left our shop. Any repairs or replacement cakes will be subject to additional fees. Any individual picking up a cake must be at Margarita’s Bakery on or before the agreed upon time and arrive in a vehicle appropriate to transport said order. Late arrivals understand that Margarita’s Bakery has the right to leave if the agreed upon time is not honored by the customer with no refunds available. Please be on time.
WEATHER / CLIMATE CONDITIONS
It is your responsibility to ensure that the cake will be stored and set-up in an area that is climate controlled to ensure that the wedding cake remains intact and retains its original condition. Extremely high temperatures and humidity due to weather conditions and the lack of a cool environment at the appointed location may adversely affect the condition of the cake. Margarita’s Bakery will take every step possible to ensure a quality product upon delivery. Margarita’s Bakery cannot be held responsible for unfavorable conditions at the cake’s destination. Please note that direct sunlight and temperatures of 75 degrees and higher may have drastic and adverse effects on any confection ordered.
FRESH FLOWER USAGE
If fresh flowers are requested, you acknowledge that fresh flowers are not a food product, and may be toxic or contain toxins, pesticides, insects, dirt, or other contaminants. The responsibility of the flowers safety, freshness, color, and safe food practice will rest with the florist and NOT with Margarita’s Bakery. Please have your florist provide the correct type and number of flowers needed to complete your desired design.
We require that you or your florist deliver your flowers at least 1 hour prior to our agreed upon cake delivery time. If flowers are not present at the time we arrive, we cannot remain on site for more than 10 minutes after we arrive and the rest of the desserts are set up. This is due to our often tight delivery schedule of other wedding cakes and desserts. If we must leave without the flowers being added to your cake, it will be your or your wedding coordinator’s responsibility to decorate the cake with the flowers upon our departure. We are not responsible for damages that occur if other parties attempt to place flowers on the cake. If you request gum paste flowers from another vendor, we will make every attempt to order them in time for your event. In all cases, it is your responsibility to give us sufficient lead-time to order flowers, and you agree to pay additional shipping charges if necessary.
CUSTOMER SUPPLIED ACCESSORIES
Fabric ribbon and any other accessories that Margarita’s Bakery agrees to add to your cake must be brought into Margarita’s Bakery at least 1 week prior to your cakes ready date.
All attempts will be carefully made to coordinate and/or match your colors, however, please be aware that food colors do not always perfectly match fabric, flowers, table coverings, napkins, etc. Depending on the mediums used, colors can be slightly altered by ingredients (i.e. butter and white chocolate can cause slight variations). Food colors may also fade if exposed to bright light.
We photograph our cakes and we reserve the right to use any photographs for display or promotional uses without compensation to you and/or without your permission.
We use the finest quality ingredients in our bakery. Our products may contain milk, wheat, nuts, and other allergens. We are not responsible for any allergic reactions.
Margarita’s Bakery cannot guarantee that any of our products are 100% free of allergens in either of our Bakeries. The desserts you and your guests will consume could come in contact with other food items outside of our bakery (i.e. at your event) that could cause allergic reactions in some people. Please inform your guests that it is their choice to consume our product, and Margarita’s Bakery is not liable for any allergic reactions. All of our traditional products are prepared on shared equipment. We are happy to discuss our methods of preparation with you at any time.
Margarita’s Bakery makes every attempt to ensure that your baked goods are free from foreign objects. We are not responsible for damages caused by foreign objects such as candles, sparklers or other decorations that are placed on or in our products, nor are we responsible for damages to said products, or persons handling them once they are picked up, removed, or delivered from our premises.
All cancellation requests must be made in writing or email (email@example.com). In the event you need to cancel your order, there's a 50% non-refundable fee. If you cancel your order within 7 working calendar days of the event, no refund will be given for any amount paid. In the event of unforeseen circumstances (not including acts of God, natural disasters, or inclement weather) that prevents Margarita’s Bakery from fulfilling the order as agreed upon in this contract, the customer will be entitled to a full refund of the amount paid, including any deposit.
If you set up your order less than 7 days before the delivery/pickup, no refund option will be available.
REFUNDS & RETURNS
All sales are final, with the exception of custom orders canceled before 7 working days.
- We strive to decorate the exact cake design you want. But once the cake has been picked up by you or a designated party or delivered, it is considered “accepted”. Refunds requested due to decorating style, color shade choice or general decoration design would not be honored. Partial or full refunds are decided on a case-by-case basis, but please note that we do not provide refunds in cases where an item was prepared correctly but a flavor or texture did not meet a personal preference.
- If upon picking up your cake, you are not 100% satisfied with the look of your cake, you are NOT obligated to take the cake. If you choose not to take the cake, you will be issued a partial refund, via original purchase method. Upon pick-up of your cake, adjustments to the cake decoration can be made for an additional charge.
- To be able to receive a full refund (minus a handling fee) you need to bring your item back to the store. If you can’t bring it back, you’ll be able to receive a discount on your next order but it is decided on a case-by-case basis.
- Once the cake leaves our shop, you may bring the cake back in for design adjustments, however, there may be a charge for this service as well.
- We are not responsible for any damage occurring to the cake during transport, set-up or any time thereafter.
